Equal Access to Justice Act (EAJA) Fees in SSD/SSI Cases (Free)

Description:
This training will cover the law and practice for obtaining Equal Access to Justice Act (EAJA) attorney's fees in SSD/SSI cases. The training will examine the prevailing party requirement; the interaction of EAJA and Social Security Act fees; Sentence 4 versus Sentence 6 applications; the contents of an EAJA petition and the time limits for filing; hours and hourly rates; allowable expenses, best timekeeping practices; the "substantial justification" defense; and settlement of fees with the U.S. Attorney. The training, however, will not address motions for approval of contingent fee agreements under 42 USC section 406(b). Course materials will include primary sources of statutory and decisional law, and model forms.
