PUBLIC COMMENT on State Bar proposed malpractice insurance disclosure rules

The State Bar of California is accepting public comments on the proposed rules that attorneys be required to disclose to clients and the State Bar whether or not they carry malpractice insurance.

The two proposed insurance disclosure rules would require (1) direct disclosure to the client if an attorney is not covered by professional liability insurance; and (2) disclosure to the State Bar if an attorney is not covered. The bar would make publicly available the names of lawyers who are not insured.

The deadline for public comment in September 15, 2006. Only written comments are being accepted.
