Landlord Expo Assisted By Legal Community

On Saturday, May 15, The Housing Council held its annual Landlord Expo with various members of the legal community supporting the efforts to educate landlords, realtors and property managers.

The Lawyer Referral Service of the Monroe County Bar Association participated as part of its ongoing efforts to build public awareness that the service is a resource for people to turn to when searching for an attorney. Upcoming LRS Chair, Steve Modica, as well as private attorneys Marc Album, Walter Capell and Kathy Perrault of Volunteer Legal Services Project answered questions on tenant issues, general real estate topics, and how to handle collection matters.

Anthony DiNitto of Faraci & Lange provided a brief demonstration on property liability issues and Rochester City Court Judge Stephen K. Lindley, spoke on "Why, When and How to Petition for an Eviction."

Another timely program was "Lead Paint and Running a Profitable Rental Business" presented by attorneys Ernest Santoro and Brendan Baynes along with speakers from the Monroe County Health Department and The Housing Council. Kathia Casion from The Legal Aid Society was also on hand to provide information on leases.

For real estate property owners, deciding which business entity formation is most appropriate for their situation has become more complicated with liability issues on the rise. Jim Cummings discussed the advantages in forming limited liability companies for basic asset protection planning. An LLC can be set up within days and deeding properties into LLCs can be fairly straightforward if property is already owned. As with many business decisions, the best time to evaluate these options is before there is a threat from creditors or litigants.
