Trust and Estate Planning Basics for Foreclosure Advocates
- Wills / Estates
Foreclosure advocates frequently encounter trust and estate planning issues when dealing with distressed homeowners. How should a foreclosure action be commenced against a deceased homeowner/mortgagor? In the absence of an appointed executor/administrator, how do you deal with the property held in a deceased person's name? Who are the beneficiaries of an estate when a person dies without a Will (known as dying intestate)? Who may probate a will? This training by an experienced trusts and estates attorney, Barbara Lynn Pedersen, will provide an overview of New York trusts and estates law for foreclosure advocates, focusing on the basics of intestacy, probate, inheritance of real property and assumption of mortgage indebtedness.
