SUMMARY:Breaking the Pipeline: Special Education Advocacy 
 for Court-Involved Students

 Every student -- rega
 rdless of race, income, court involvement, or disa
 bility -- deserves meaningful access to a quality 
 education. However, we know from both lived experi
 ences and available data that reality is far from 
 this ideal, especially for court-involved youth wi
 th disabilities. When schools fail to identify and
  serve these students, the denial of education can
  set a devastating cycle in motion. Without a path
  to graduation or the support the law requires, th
 ey become vulnerable to surveillance, prosecution,
  and incarceration. And once inside the juvenile s
 ystem, where students with disabilities are drasti
 cally overrepresented, the cycle deepens. Chronic 
 instability between placements disrupts schooling 
 further, agencies fail to share critical informati
 on about students' needs, and young people are fun
 neled directly into the adult criminal system with
  no diploma, no services, and no way forward.   

 
Special education law offers a powerful but unde
 rutilized tool to help break this cycle. By integr
 ating special education advocacy into juvenile and
  criminal defense, attorneys can increase access t
 o education, decrease future court contact, and re
 shape outcomes for court-involved students with di
 sabilities. As part of a holistic defense team, th
 ey can preserve both the substantive education rig
 hts and liberty interests of young people, disrupt
 ing the pipeline that funnels this population from
  the juvenile into the adult criminal legal system
 .   

Importantly, public interest and pro bono 
 attorneys can help meet the enormous demand for th
 ese services, whether by providing direct special 
 education representation for students in criminal 
 court or by supporting existing special education 
 attorneys with strategic litigation.

  litigation strategies for safeguarding the educat
 ional rights of youth while they are confined and 
 as they reenter the community – 20 minutes

 Discuss the experience litigating the Charles H. v
 . District of Columbia class action – 10 minutes  
  
>  Explore how such strategies can secure bette
 r outcomes in individual criminal proceedings and 
 in decarceration efforts generally – 20 minutes   
 
>  Present an array of options for public intere
 st and pro bono attorneys to engage in this work –
  10 minutes
