Why You Should Attend

Electronic evidence (including technology abuse) plays an increasingly important role in cases involving intimate partner violence in legal services work. Understanding the current case law and ethical rules governing the use of electronic evidence is therefore essential for legal services attorneys who represent clients in these cases. Within the context of intimate partner violence, this training will explore the many technologies utilized by legal services clients, the New York ethical rules and case law governing attorneys who are interacting with that electronic evidence, and the ways in which attorneys can realistically present evidence in the New York State courts, given the limited resources in most legal services offices. A mock trial at the conclusion of the program will illustrate the correct use of electronic evidence in direct examination, cross-examination ,and voir dire.

- Relevant case law on electronic evidence under New York State Law
- New York ethical rules governing electronic evidence
