SUMMARY:Webcast: Representing the Pro Bono Client: Advocac
y Skills for Administrative Hearings 2018 (Free)
LOCATION:PLI Webcast
DESCRIPTION:The need for pro bono assistance with administ
rative hearings has never been higher. Clients who
have been denied or are at risk of losing vital b
enefits, housing subsidies, or are facing school d
iscipline have a right to an administrative hearin
g, but are often unrepresented in what can be a co
nfusing and adversarial process. Significant chang
es to key public benefits programs, including Soci
al Security, CalWORKs, CalFresh, Medi-Cal and In-H
ome Support Services have occurred in recent years
imposing new complex rules. On the unemployment i
nsurance front, while the number of applications h
as overall declined, we have yet to see a reverse
of the recession-based trend of employers challeng
ing many unemployment insurance benefit applicatio
ns. Housing Authorities frequently seek to deny an
d revoke housing subsidies often due to tenuous al
legations of criminal activity. Meanwhile, low-wag
e workers are experiencing wage theft at unprecede
nted rates and relying on the Labor Commissioner m
ore than ever before to recover their unpaid wages
 .

Legal aid services have also suffered fun
ding problems and staffing cuts with reduced abili
ty to meet the demand to represent clients in thes
e cases. Unfortunately, there are many individuals
, who have been unlawfully deprived of critical be
nefits, are at risk of losing a housing subsidy, h
ave not been paid according to basic wage and hour
laws, and who are discontinuances from public ben
efits. This vulnerable population cannot navigate
the administrative hearing process on their own. A
s a result, low-income families face hunger, homel
 essness, and economic instability.

This trai
ning is designed to help mitigate the crisis faced
by low-income families everywhere by providing at
torneys with a basic understanding of common issue
s and strategies in providing pro bono assistance
with administrative hearings. The program will foc
us on California law, but will also cover many top
ics such as due process and other rights that appl
y nationwide; therefore, advocates from other foru
ms would benefit from the information and attendin
 g the program.
