Defending Clients in Proceedings for Violations of Orders

This training will provide an overview of the laws governing violations of orders in Article 10 (child welfare) proceedings, including orders of protection and dispositional orders, under the Family Court Act and the Judiciary Law. We will discuss under what circumstances violation petitions can be filed and the remedies that are available, as well as the standard of proof that is required and double jeopardy considerations. Finally, using an actual case, we will discuss settlement options and how to defend your client in a fact finding and dispositional hearing on a petitioner for a violation of an order of protection.
