Advanced Topics in Contested Divorces: Equitable Distribution of Pensions and Other Retirement Benefits

Attorneys will receive advanced substantive training on the equitable distribution of pensions and other retirement benefits, an issue that often arises in contested divorce matters. Often, a spouse's retirement benefits are the most significant asset accrued during a marriage. This training, in conjunction with the basic contested divorce training, will provide participants with the skills needed to identify and characterize various pension and retirement vehicles, and distinguish between them. Participants will gain the knowledge necessary to negotiate and draft settlement agreements that best allow clients to secure and preserve their rights to their former spouse's benefits. Specific pointers and caveats in the drafting and submission of Qualified Domestic Relations Orders (QDROs) will be discussed. Extensive materials and samples will be distributed.

This training is open to attorneys who are currently handling inMotion-referred contested divorce cases. It is also open to attorneys working at major law firms who have experience handling contested divorce matters, or who have completed inMotion's basic contested divorce training, or who are able to view the basic contested divorce training on video in advance of this training. Attorneys not currently handling an inMotion-referred contested divorce matter will be assigned a pro bono case at the training.
