OPEN POSITION: The Office of the State Appellate Public Defender is recruiting for qualified applicants to fill the position of Deputy State Appellate Public Defender in the Capital Litigation Unit (CLU). The current position available is for a lead attorney who meets the qualifications of Idaho Criminal Rule 44.3. Consideration may also be given to filling this current opening as a second chair attorney position, which does not require the applicant to meet Rule 44.3 qualifications.

The CLU consists of two lead attorneys, two second chair attorneys, an investigator, a mitigation specialist, and an administrative assistant. The CLU handles capital cases which are in various appellate post-conviction procedural stages. The open position represents a recent vacancy.

POSITION DESCRIPTION: The successful applicant will be representing indigent defendants in state capital post-conviction and appellate proceedings. The lead counsel position will have supervisory responsibility over second chair counsel, a mitigation specialist and an investigator as it relates to representation in the case. If filled as a second chair counsel position, the successful applicant will be part of a team representing clients at various stages of proceedings, under the supervision of lead counsel. Anticipated workload is three to five clients per team.

QUALIFICATIONS: For the lead attorney position, the attorney must meet the minimum qualifications for lead post-conviction counsel under Idaho Criminal Rule 44.3. For second chair counsel, the attorney must be licensed to practice law in the State of Idaho. Trial and criminal law experience are preferred. Excellent research, writing and communication skills are essential to both positions, as well as a commitment to team-centered representation.
