POSITION ANNOUNCEMENT: SUPERVISING ASSISTANT FEDERAL PUBLIC DEFENDER/CAPITAL HABEAS UNIT

 The Federal Public Defender Organization for the District of Delaware is accepting applications for an Assistant Federal Public Defender to be the supervisor in its newly formed Capital Habeas Unit (CHU). The CHU represents death-sentenced prisoners in
federal habeas corpus proceedings in the United States District Court, the United States Court of Appeals for the Third Circuit, and the United States Supreme Court. This is a full-time position located in Wilmington, Delaware.

The supervising Assistant Federal Public Defender for the CHU will be responsible for managing the CHU and will report directly to the Federal Public Defender. The successful applicant must: (1) be a talented legal writer and a proven advocate and litigator in capital habeas cases, with substantial experience handling capital post-conviction or capital appellate cases; (2) be immediately able to undertake both the representation of petitioners in capital habeas proceedings in federal court from the initial petition through
appeal and clemency, if needed, as well as the hiring, training, and supervision of a staff charged with the same responsibilities; (3) be team oriented, committed to indigent criminal defense, and able to foster the office’s role as a resource to the Criminal Justice Act panel
members in capital habeas cases; and (4) have at least five (5) years of relevant experience, be a graduate of an accredited law school, and be a member in good standing of the highest court in the state where licensed.

Some management experience is preferred, as is either current or prior employment by a CHU. A background in any area of mental health and/or social work is also helpful. This position requires occasional travel. This is a full-time position with federal salary and
benefits based on qualifications and experience. Assistant defenders may not engage in the private practice of law. The successful candidate will be subject to a general background check. The position is subject to mandatory electronic transfer (direct deposit) for payment of net pay.
