Summary: Despite increasing assaults on the immigration system by the current Administration, asylum remains a viable option for many LGBTQ immigrants fleeing persecution in their home countries. Applicants who fear persecution based on their sexual orientation, gender identity and/or HIV status often have strong claims to asylum, but may face unique barriers to winning their cases. In this webinar, attorneys from Whitman-Walker Health and Ayuda will provide an overview of how people from the LGBTQ community may qualify for asylum, overcoming common obstacles to eligibility, and how to get involved in pro bono immigration cases. Participants should already have some familiarity with basic asylum eligibility requirements. Some of the topics covered will include:

  • Best practices for working with LGBTQ asylum-seekers
  • Framing cognizable Particular Social Groups (PSGs) based on sexual orientation and gender identity
  • Documenting exceptions to overcome the one-year filing deadline
  • Addressing changing case law around private actor violence and advancements in LGBTQ laws
