Occupational Disease Claims: Recent Legal and Medical Developments

Recent decisions in the First Circuit and federal district court for Massachusetts have addressed the admissibility of medical opinion regarding the cause of occupational disease, both for trial and summary judgment purposes. This discussion will include a legal analysis now being applied by the courts, and medical analysis applied by occupational health professionals, in this challenging intersection between toxic torts, regulatory law, and science. This session will be of special interest to those with personal injury and workers compensation practices, and anyone relying on, or defending against, complex expert opinion at the motion and trial stages.
