January 2012 Volunteer Feature: Proskauer Rose Volunteer Attorneys Successfully Close Challenging Removal Cancellation Case for City Bar Justice Center Client

Mr. Z had a traumatic childhood in New York City; he was abused, removed from his home by the Administration for Children’s Service, and endured homelessness. As a result of this trauma, Mr. Z was ill-equipped to make sound decisions which resulted in minor contacts with law enforcement. Mr. Z was in danger of removal from the United States to China, and came to the Varick Removal Defense Project at the City Bar Justice Center for help.

Andrew Kleiman and Garrett Wright of Proskauer Rose LLP took on Mr. Z’s case knowing that, although modest, his criminal history presented a substantial hurdle for his ability to remain in the United States. They were meticulous and methodical in developing the strategy for the case. They had the foresight to retain an expert in trauma who ultimately concluded that Mr. Z’s Post Traumatic Stress Disorder contributed to the poor choices that led him to have contact with law enforcement. That diagnosis was critical to their theory of the case, and after nine months in detention Mr. Z was granted cancellation by the immigration court.

The team’s skillful preparation of witnesses in anticipation of cross examination was beyond remarkable; they promptly scheduled multiple meetings with their client, family members and the expert. Because of the team’s tremendous preparation, Mr. Z was able to overcome his timidity and articulate his claim effectively. The team exhibited tremendous sensitivity, handled direct examination with ease and was the model of effective and competent representation.

“There is no doubt in my mind that had their client been represented by less able attorneys, he would not have been granted cancellation,” says Barbara Camacho, Fragomen Fellow with the City Bar Justice Center. “Andrew and Garrett deserve much recognition for their dedication and diligence on this case.
