Practicing law in 2012 brings with it a complicated and ever-changing series of new challenges as a result of technological advances. With each new development that is intended to make a job easier, save a lawyer valuable time, or help a businessperson communicate more effectively, attorneys must consider the ethical consequences of utilizing the latest tools.

A mere thirty years ago, lawyers did not have to wonder about the ethical use of global positioning technology, e-mail, cell phones, miniature cameras or microphones, keystroke programs or computer hacking, or confidential information "hacked" on the Internet. People were not posting pictures of themselves online with paramours, much less posting pictures of themselves on dating sites in an effort to have extramarital relations. Television programs still portrayed attorneys as heroes, not as adulterous money grubbers with more personal problems than courtroom skills. In short, times have changed.

During this entertaining program, David Masterman will walk through a series of

hypotheticals that address the ethical considerations associated with:

• Using Facebook and other social media to market your law practice

• Talking to the media about an ongoing matter in your law practice

• The use of photographs on cell phones as evidence in a legal matter

• Accessing opposing parties' e-mails for use as evidence in a legal matter

• Potential conflicts of interest as a result of e-mail exchanges with potential clients
