Common estate planning techniques must be modified to fit extraordinary circumstances, especially when the safety net of intestate succession is not available as a rule of default or when other laws, like the augmented estate laws, will affect certain planning decisions. Second, third, and fourth marriages are no longer uncommon. Estate practitioners need to understand the intricacies of estate and family planning mechanisms to provide their clients with the best protection given life uncertainties. Such planning is not only for the affluent. We now have whole sets of family members we are obliged to support and those for whom we wish to preserve and pass our wealth.
