Equitable Factors in IDEA Cases

This training will address the factors considered by Impartial Hearing Officers, the State Review Officer, and courts in determining whether a parent is equitably entitled to relief sought under the Individuals with Disabilities Education Improvement Act of 2004. The training will focus on cases involving parental requests for private school tuition payment and other cases analyzed under the three prongs of School Committee of Burlington v. Department of Education and will include an examination of the IDEA, its implementing federal and state regulations, State Review Officer decisions, and federal case law.
