This session will provide an overview of subprime and predatory lending and real estate practices, factors that contribute to the current crisis (including securitization), the players and the discriminatory impact on New York City neighborhoods. Learn about key federal statutes governing mortgage lending, including the Truth in Lending Act, the Homeownership and Equity Protection Act, the Real Estate Settlement Procedure Act and the new Housing Rescue and Foreclosure Prevention Act, as well as relevant state laws. We will review key loan documents and discuss how to spot violations and other issues that may give rise to affirmative claims or defenses.
