Hi Consumer Advocates,

FYI, the Sykes v. Mel Harris appeal on class certification will be heard in the Second Circuit (40 Foley Square) on Friday, February 7 in Courtroom 1703. Argument starts at 10, but we are last on the calendar, so it's doubtful it will start before 11. We will know who the panel is this Thursday.

MFY and New Economy Project's excellent co-counsel, Matt Brinckerhoff, will be arguing, and the CFPB, which filed an amicus brief (as did NYLAG and AARP), was granted permission to argue, too. Paul Clement (http://en.wikipedia.org/wiki/Paul_Clement) and Miguel Estrada (http://en.wikipedia.org/wiki/Miguel_Estrada) will be arguing for the defendants, so it should be interesting.
