California's Unfair Competition Law (Business and Professions Code ยง 17200 et seq.) has long been a key tool for consumer and public interest advocates seeking to rein in corporate malfeasance. With the passage of Proposition 64, a business-sponsored initiative intended to limit the statute's reach, many new legal questions arose concerning how unfair competition cases would be litigated, including whether class certification is required and if so, whether all class members must have sustained actual injury. Another potential tool is the Private Attorneys General Act (PAGA), which allows employees to seek penalties for Labor Code violations. This program for public interest litigators will address the important recent appellate decisions that have clarified these laws and how they may be used in public interest litigation. (Intermediate to advanced level).
