ABA Death Penalty Representation Project

The Death Penalty Representation Project's mission is to improve the systems that provide legal services to poor people charged with or convicted of capital crimes; to educate the bar and public about the crisis of counsel for death row prisoners; and to recruit, train and support lawyers to take on capital post-conviction cases as pro bono counsel. There are currently more than 3,800 persons under sentence of death in the U.S., and hundreds of death row inmates are currently without counsel. While each individual has the right to seek post-conviction review of his conviction and sentence, there is no federal constitutional guarantee that a lawyer be appointed in these proceedings. The Project has placed more than 100 cases with major law firms as volunteer counsel for capital post-conviction cases, and lawyers in smaller firms have signed on to draft appellate briefs, certiorari and clemency petitions. The Project ensures that volunteer attorneys receive guidance and support from an experienced capital litigator serving as resource counsel. The Project has a secured practice area on www.probono.net, a website created by the Open Society Institute to encourage and support firms that are serving as pro bono counsel. The practice area has online support and resources for its participating lawyers, including news, a calendar of training events, listings of jurisdictions with urgent need, and an online library as well as links to other websites that are useful to lawyers representing death-sentenced prisoners.
